As we just discussed in a previous post, TMZ reported just hours before Brad Pitt’s Allied premiere that Brad has been “cleared” of all charges in the eight-week DCFS investigation into his conduct on that private plane back in September. The details were always rather fuzzy, but there was an argument between Brad and Angelina, and it got so bad that Maddox tried to get in between them. Brad and Maddox might have gone nose-to-nose and Brad might have struck Maddox in some way, perhaps accidentally, perhaps not. What was supposed to be an investigation into just the plane incident ended up being extended for several weeks as DCFS allegedly investigated further incidents within the family. But now Brad has been cleared. And following that announcement, Angelina’s rep released a statement:

Angelina Jolie is chomping at the bit to prove Brad Pitt abused at least one of his kids, and she thinks the divorce judge will believe her allegations and limit Brad’s custody. TMZ broke the story … the L.A. County Dept. of Children and Family Services has closed its child abuse investigation into an incident on a private jet between Brad and 15-year-old Maddox.

Angelina has filed for primary physical custody of the 6 kids … Brad has responded, saying he wants joint custody. Sources connected with Angelina say she feels the kids would be at risk if Brad gets joint custody, and if he doesn’t drop his claim she’ll present evidence to the divorce judge that Brad has committed abuse.

A rep for Angelina tells TMZ, “Angelina said from the beginning that she felt she had to take action for the health of the family and is relieved that after their 8-week involvement, the DCFS is now satisfied the safeguards are put in place that will allow the children to heal.”

The rep adds there’s a legal agreement in place, signed by both sides, in which Angelina currently has primary physical custody and Brad has monitored visitation. As we reported, however, that agreement was in place only during the DCFS investigation. Now that the investigation is closed, Brad and Angelina will have to duke it out before the divorce judge.

It’s true, I believe, that now that the DCFS investigation has been concluded that now the table has been set for a major custody battle. This is why both Brad and Angelina spent weeks assembling their legal and crisis-management teams in those first weeks – because both sides knew it would probably come to this. I don’t know what to make of TMZ’s sources saying that Angelina has “evidence” that Brad committed abuse, especially if she didn’t give that evidence to DCFS, you know? Ugh. The only thing I can say for sure is that I’m absolutely positive this is going to get uglier before it gets any better.
